Mobile Systems Europe SPRL (CBE 0879.633.414 – “MSE”) processes your personal data (your identification data, your location data and your financial details) and, where applicable, those of users (whom you undertake to inform of the content of this clause). The processing of personal data is based on contractual relationships (Article 6(1)(b) of the General Data Protection Regulation “GDPR”), MSE’s compliance with one of its legal obligations (Article 6(1)(c) GDPR), the consent of the data subjects (Article 6(1)(a) GDPR) and/or the pursuit of MSE’s legitimate interests (Article 6(1)(f) GDPR). The data are processed for customer management purposes or, where the data subject has given explicit consent, for commercial prospecting purposes. These data are processed for the time necessary to achieve the purposes and will in any event be retained for a maximum of 5 years after the end of the contractual relationship, unless further retention is necessary to comply with legal obligations (in particular accounting obligations). MSE may use processors (e.g. IT infrastructure, servers located abroad, installers) who process personal data on its instructions, in its name and on its behalf. MSE undertakes to take the necessary measures to ensure the confidentiality and integrity of the data and, where processors are established outside the EEA, to ensure an adequate level of data protection (e.g. by signing EC standard contractual clauses or ad hoc contractual clauses, all available on request). The data may be transferred to third parties (e.g. Google, the monitoring centre), who are responsible for subsequent processing carried out for their own purposes and by their own means. For any request in this regard, the customer may contact the relevant third parties directly. Where required by law or justified in the specific circumstances, MSE may also disclose your data to law enforcement authorities such as, for example, the Data Protection Authority. You have the right to access your data and to have it rectified if it is inaccurate or incomplete, to have it erased, and to have processing concerning you restricted or to object to it in the cases provided for by law and, where applicable, the right not to be subject to an automated individual decision (including profiling). You also have the right to receive the data concerning you in a structured, commonly used and machine-readable format, and to have it transmitted to another company (right to data portability).
